Brooklyn, NY - Ruling From Court in Satmar Case

Brooklyn, NY - Supporters of Rabbi Zalmen Teitelbaum won a huge victory in their seven-year-long brawl with followers of his brother, Aron, for control of the 120,000 Satmar Chasidim and their millions of dollars of real estate, including a matzah factory.

An appeals court panel in Brooklyn issued two rulings siding with Rabbi Zalmen's faction.
One decision was 3-1 affirming a lower court decision from 2004 that left Zalmen's side in charge of the Satmar congregation in the Williamsburg section of Brooklyn by refusing to intervene in what was deemed an off-limits religious dispute.
The other wich was 4-0, overturned a decision Stewart Rosenwasser made in February as an acting state Supreme Court justice in Orange County, a decision that waded firmly into the religious dispute and declared Rabbi Aron's side the winners.

The court unanimously also invalidated a deed transfer that would have given half ownership of the cemetery in Kiryas Joel where Rabbi Moses Teitelbaum and his uncle, Rabbi Joel Teitelbaum, are buried to the congregation there, which is under Aaron Teitelbaum’s authority. Instead, the court left the entire control of the cemetery with the Williamsburg congregation and under Zalmen Teitelbaum’s authority.

The long-awaited decisions by the Appellate Division of Supreme Court are a stinging defeat for Aron Teitelbaum, who has led the dominant Satmar congregation in Kiryas Joel for a quarter century and now their future was been thrown into doubt.

    Barasch's decision was affirmed (that its a religious matter so the court can't say anything), leaving open the question WHO is indeed the President of the cong.

    Even if the Aronis appeal they are going to have a verd and uphill battle. The brooklyn decision was affirmes 4-0 and lets the Court of Appeals overturn that!! It just is not going to happen..If I was Aron I'd start funrausing since he's going to need to build a new BM in Williamsburg.

    Does anyone know the title of the case (Who v. Who)? I want to read the judges opion on Lexis Nexis but I need to know the title of the case? I'm imagining that if it was rendered yesterday there are no cites for it but I can check by the parties names.

    Actualy the ruling is that the court can't say anything regarding who is boss because it involves ecclesiastical issues, leaving only one of the two options which Barasch gave to solve this dispute, 1) "the Rebbe should say what he wants" which they say that Rossenwasser wasnt able to say what the Rebbe said because of the above issues, 2) "it should be decided by a Din Torah" which doesn't look like (for whatever reason), So in other words, if you dont go to Din Torah then "Kol D'Alim G'Var".

    Anonymous 9:30 AM; Do you know that in NYS there is a "Suprem Court" then an "Apealat Devision" and then a "Court of Apeals" (and then you can even try to go to the United States Suuprem Court), so whats the problem to apeal it again? (there are still 2 chances left...).

    This decision leaves open a lot more than it solves. In a nutshell, the jusdges said it's none of their business.

    That's hardly a resolution to the issue. The only thing it does do, is it forces Ahron and his supporters to come to the negotiating table with Zalman Leib's team.

    Barasch's decision was appealed by B.Friedman (although Y.Kahan gave in a cross appeal, but he withdraw that appeal,) so he is the appellant an that case, while Rosenwassers decision was appealed by Y.Kahan so on that case he is the appellant

    FYI - it did go to Bais din already and there too the Aronis lost. But alas, their leader decided that Bais Din was not a good one.....bottom line is this man is by force trying to take everything. He is an instigater and a promotor of physical actions as wwell. He has lost his mind!. The only good thing about this is now we have 2 magazines each week with Gedolim pictures. One that claims R' Zalman the Kakadmor and one that doesn't and one that claims Halberstam the Kakadmor of Bobov and one that claims Unger is...go figure....Satmar fights Aron vs Zalman, Bobov fights halberstam vs Unger, Lubavitch fights dead vs alive.....what's next?

    I Read the decision over and over and this is my analysis:

    on the main issue of who is "STATUS QUO" it is clear according to the ruling that Mr. Berl Friedman was the un-contested president on January 14, 2006 after that date there is disagreements between the parties which the court now says that they are not mixing in, so "STATUS QUO" means that the last UN-contested time there was a president it was Mr. Berel Friedman, therefore, Mr. Friedman is the PRESIDENT of Cong. Yetev Lev according to this ruling.
