Williamsburg, Brooklyn, NY +Child Struck+ A motor vehicle accident in front of 403 Marcy Avenue between Middleton Street and Lorimer with a 5-year-old child that was struck by a vehicle that passed a school bus while picking up children and had its red flashing lights on and its stop signal out, child is in traumatic arrest life threatening, Hatzolah on the scene requesting Medics on a rush. My daughter who lives accross the street is an witness. The driver passed the bus while the lights were flashing. A detective was just by my dauther's house to take additional information and he said
that the bus is in perfect condition and the lights were in order, it looks like it was the driver of the cars fault.

It seems like the police were focusing on a scratch on the BMW's passengers mirror, they measured the height of the bottom portion of the bus's "Stop" sign and the top part of the BMW's mirror to determine if the mirror hit the stop sign, which would clearly indicate that the flashing stop sign was out while the BMW passed.

I am not from Brooklyn and I did not know this child or any members of her family. All I do know is that I sit here with tears in my eyes as I weep for the pure neshama of a Yiddishe kind which has been called back way before its time. May Hashem who is the only Entity that understands the full picture give strength to the family to go on. There is a new rule that a bus driver can not block the street. He must remain straight.
We see it every day. Cars speeding right by school buses with the red lights flashing. I’m not here to bash Acheinu Benei Yisroel, but I see it DAILY. Cars don’t even slow down. And if you do have the CHUTZPA to stop for flashing red lights cars behind you get so irritated they honk at you and try to cut you around. Both, heimishe people and lehavdil non yidden are doing this.
Where is the police on this one? They should bake a TICKET BLITZ every day for cars passing flashing red lights.
The law states that even an ambulance has to stop and wait for flashing red lights. You man only pass if the drivers waves you on.
It also has to be pointed out that “SOME” drivers abuse this and are know to run into a store to get a coffee while forgetting their flashing red lights. Good bus drivers pull over to the side after every few blocks and let cars pass.

And our “Friendly Neighbors” who gave statements to the press are wrong as well. There are the people who would send their dogs chasing after yidishe kinder when you walked pass on Lynch St. a few years back. This Latino women just said the mother should have been there. Very nice to bash others. There are a few families sending to this school and they share their responsibilities and “Mother Pool” every they another mother.
I am not a biased person. I work with Black, Hispanics, Russians and few others. Plenty of different ethnic backgrounds and we get along very nicely. There are however a few Spanish people living in that area who are making trouble.
I have a friend who had a minor fender bender in the area and they almost lynched him. They called friends on their cell phones and made a whole hula. My friend called me for help and I came down with my video camera and from across the street starting taping discreetly. Guess what. A friend shows up in his car, parks not far away and claims he was in the car hit. His back hurts and he has problems breathing. He is taken to the hospital by ambulance. When the lawyers started having fun, we called our insurance who send down their own investment team together with the National Insurance Fraud Prevention. We shoed our tape and this guy was arrested.

5-Year-Old Girl Killed By Car In Williamsburg Is Laid To Rest
June 20, 2006
The funeral for the 5-year-old struck and killed Tuesday morning was held this afternoon, just hours after her death, in accordance with Orthodox Jewish tradition.
Dozens of community residents were in attendance to pay their respects to Chana Friedlander, who was hit by a blue BMW when she darted out between two parked cars on Marcy Avenue Tuesday morning.
According to investigators, the child, who was on her way to Beth Chana School for Girls, was supposed to wait on the sidewalk for the bus. Instead, as the bus driver picked up another student on the other side of the street, Chana ran out between parked cars and was struck by a blue BMW.
"I stopped here to pick up two children from both sides – this side and that side – put on the flashing lights, opened the door and all of a sudden in my mirror, I see a car right near my bus and I beeped her to stop,” said the bus driver Jenoe Lichtman. “I blowed the horn [for her] to stop. She ignored everything. She passed the red lights, the flashing lights, and hit the child."
But police say they're still trying to verify the bus driver's story that his flashing red lights were indeed on. If so, the driver of the BMW would have been required by law to stop.
The driver of the BMW, Trisha Thomas, is an occupational therapist who works with children at a local public school. She stayed at the accident site, but was then taken to Wykoff Hospital in shock.
Chana died at the scene.
“The blood was coming very bad from here, the side of her head,” said eyewitness Solange Nsunda. "She was already dead because the blood was coming very bad."
The accident happened at 8:30 a.m., and by 1:30 p.m. funeral services were held in accordance with Orthodox Jewish tradition, which calls for burial before sundown.
"This is going to leave scars for the family and for the community and for the children in school,” said Rabbi David Niederman of United Jewish Organization. “A seat at the school is going to be empty. Somebody will have to explain to the children why that seat is empty."
The investigation into the accident is being conducted by both the NYPD and the State Department of Transportation. No charges have been filed.

The reason why nobody stops for flashing red lights is because BUS DRIVERS ABUSE IT!! by being park infront of a school unloading kids and not turning off the red lights. And this happens infront of all the public schools.
There's no reason to turn on the red lights when the bus is parked along the sidewalk.

I said yesterday that I’m not a racist. I work with black and Hispanics as well as others. All I said was to this stupid bigot who blamed Chasidic Jews, that the driver was black not Jewish.
Of course, she should not be blamed because she is black. However, why wasn’t she fined yet? She passed a school bus with blinking lights. There are numerous witnesses who saw her pass at a high speed. The bus driver also saw her coming in his mirror and honked the horn.

I recall reading somewhere (probably on the Web) that in Japan any driver who is involved in an automobile accident that results in a fatality, whether the driver was responsible or not, automatically loses their driver's license for life. A quick internet search could not confirm this, but I like the idea.
We have been conditioned in this country to accept death-by-automobile with a collective shrug. That it's life in the "fast lane" and that is the price we pay for our supposed quality-of-life. We can't expect the police to ascertain guilt - as full-time occupants of their police cars, they relate to auto traffic more than pedestrian traffic. They too are conditioned to quickly write up a report as an "accident" - where often "negligence" or "carelessness" can be substituted for "accident".
All too often, we read about car accidents in New York where a pedestrian is killed by a turning bus, a van careens into a crowded sidewalk or a cyclist is forced by one auto into the path of another auto, and the story ends the same: no charges were filed. No, it's not easy to ascertain responsibility in most auto accidents. However, I don't trust the NYC police to do full and thorough investigations, as it seems their goal is to file a minimum of paperwork and, in knee-jerk fashion, dismiss auto fatalities as "accidents". Sadly, this has also become acceptable procedure to most New Yorkers.

I also live and work and drive around in this neighborhood a lot. All buses are using their flashing lights. You are out right wrong by saying “the buses operated by the hasidim rarly use the stop sign”. (not to mention that you, I assume, not a Chasid, don’t know how to spell. See the bold type). OK… It is only a blog. I forgive you for the spelling. But fact is all buses use their flashing red lights. Maybe too much. I know some good drivers that stop and pull over every few blocks so cars can pass. Those who don’t use it are the exception. I had not seen it yet.
And yes… I wrote earlier that I’m not out to bash my fellow brothers, but you are 100% right on your second point. Everybody is glued to cell phones! But it’s not only the Chassidim! It’s all drivers.
It is also the right place to mention that many in this community (and yes… Chassidim are guilty of this just the same) do not follow the basic traffic laws. Forget about right of way, yield for pedestrians, etc.

1) Never pass a school bus with flashing lights. Even an ambulance may not pass! It is the law.
2) If you want to turn left and I want to go straight, I have the right of way! Example: If I come up Division Avenue from Kent and wait for the light to change at Division corner Wythe and you (yes, you that almost crashed in me today and blamed me!) are coming from Bedford Avenue and wait on Division corner Wythe and want to turn onto Wythe, be a Mench and give me the right of way!
3) Turning vehicles, yield for pedestrians! If you turn from Ross St. onto Lee Ave., stop and wait for ME if I cross the street. It is the law! This law by the way extended last year to include pedestrians on the other side of the yellow line as well on a two way Stree.

I firmly believe that if you see a Bus Driver (jewish or otherwise) speaking on a cell phone during driving ,whether with or with out a headset, should be reported to his superiors. And if his/her superiors fail to doanything then just report him/her to the cops.

In light of the above criticism of school bus drivers who fail to “transport” these innocent children in a responsible manner I would like to relate a personal tale. I recently used the prospect park to get to my office in Williamsburg. to those who are not familiar with that route at the exit of the park there are two lanes which branch in to three lanes followed by a traffic light thereafter. Somehow this little mini bus full of kids and I almost collided when we both headed at the same time for the center lane. I immediately halted and made room for him to get there. He opened his window and shouted that we Jews think we own the world and that I should go burn my warehouse down! (it was approx. at the time of that big fire) being who I am I later nastily cut him off on Vanderbilt ave and that scum ball just went right on to the crowded sidewalk and cut around me trying to block me in- came out of his bus (motor running and full of little kids) to fist fight me of course I did not hang around and almost ran him over when I gassed off. There was no company tel.number on the bus only the name DF Transportation. any more info would be appreciated!

School Bus Safety - Laws and Regulations

In light of the recent tragedy that happened in Williamsburg and the rash of crashes that had taken place here in our community, we are publishing the Laws & Regulations that apply to Buses. We request that everyone please read this publication and take care to follow it, this is our children’s safety at stake!
Safety Tips: A Must for Everyone!
For Children:
• Do Not approach the bus until it comes to a full, complete stop and the door / stop sign is open.
• When you get off the bus, take five giant steps away from the bus, out of the danger zone.
• Cross in front of the bus, and make sure the bus driver can always see you.
• Never Never go back for anything.
• Never bend down near or under the bus.
• Never walk behind the bus, even when the bus is not in motion.
For Parents:
• Please go over the above rules with your children.
• Assure your children that you won’t get mad if they do not go back onto the bus for anything they may have left behind.
• Instruct your children to never look for school work they may have dropped under or near the bus.
• Make sure all drawstrings on backpacks and clothing are shortened or removed to lessen the likelihood of them getting caught in bus doors, railings and / or aisles.
• Please be waiting outside Five minutes before bus’ arrival, do not wait until you hear the bus honk. If you are late, the bus cannot wait for you. Your friends are also waiting at the other stops. Routinely using the horn to alert children that the bus has arrived is not its proper use. Honking the horn is to be used as a danger signal to warn students that a car is approaching.
• According to the law, there is absolutely no eating or drinking on buses due to choking hazards (as has happened in the past). It is advisable not to send any food on the bus. If need be, please send food in a closed, sealed bag and advise your child that it should only be opened once she reaches school.
Parents Be Advised: The driver of a vehicle overtaking from either direction, even on divided or multi-lane roads, any school bus with its red lights flashing and / or stop sign arm out will be fined. Passing a stopped school bus is a 5 point violation, plus a $250.00 fine, for a first time offender!!
Remember, the drivers have nothing against you and are looking out for the safety of their passengers!!! Please work together with them to insure a safe, smooth ride to and from school!

DID YOU KNOW:
An estimated 50,000 motor vehicles illegally pass New York State school buses every day.
In the last 5 years 35 students were hit by motorists in New York State passing stopped school buses. Two students were killed.
THE LAW SAYS:
It is illegal - and very dangerous - to pass a stopped school bus when the large red lights located on top of the bus are flashing. Flashing lights mean the bus is picking up or discharging students.
You must stop whether you are approaching the school bus from the front or overtaking it from the rear.
You must always stop for flashing red lights, even on divided and multilane highways and on school grounds.
The first-time fine for illegally passing a school bus is a $250 fine, 5 points on your license, and/or possibly 30 days in jail.
Worse yet, the memory of hitting or killing a child may be one you carry for the rest of your life!
PENALTIES FOR PASSING A STOPPED SCHOOL BUS:
First Conviction you will get a minimum $250.00 fine and a maximum $400.00 fine, and it is punishable by up to 30 days Imprisonment.
Second Conviction (within 3 years) you will get a minimum $600.00 fine and up to $750.00 fine, and it is punishable by up to 180 days Imprisonment.
Third or Subsequent Convictions (within 3 years) you will get a minimum $750.00 and up to $1,000.00 fine, and it is punishable by Up to 180 days Imprisonment.
REMEMBER:
Yellow lights mean the bus is going to stop. Slow down!
Red lights mean students are getting on or off the bus.
STOP! STOP! STOP!
The goal of Operation Safe Stop is to proactively educate motorists about the dangers of passing stopped school buses.

s/o was telling me a story that she was going to take her child off the bus as she was going to the door of the bus and the child was comeing off a lady went on the side of the bus because she was going to miss her childs bus
this is a true story and it is a story that took place two weeks ago
THIS MOTHER WAS PASSING A SCHOOL BUS BECAUSE SHE WAS GOING TO MISS HER CHILDS SCHOOL SHE COULD HAVE RAN OVER THE CHILD COMEING OFF THE BUS.
drivers if you are going to miss you childs school bus because you are waiting for a child to get off the bus you should try to be home at least 5 min. before you child comes offthe bus and if you cant you should call someone to take your child off the bus

BUS GIRL 'FELL' UNDER TRUCK

June 22, 2006 -- The tragic 5-year-old Brooklyn girl killed by an SUV as she ran to catch a school bus, likely tripped and fell under the vehicle as it passed, her head crushed by a back wheel, police sources said yesterday.
Initially, cops were probing whether the SUV driver, Tricia Thomas, 27, had hit little Chana Friedlander outside her Williamsburg home Tuesday morning.
But accident investigators now believe there was never any head-on or side-impact with the girl and that she was already on the ground, probably from a fall, before Thomas' rear left wheel ran over her head, sources said.
No decision has been made yet on criminal charges.

Yep that right ! the kid could be dancing in front or side of the bus IT IS STILL ILLEGAL TO PASS A FLASHING RED LIGHT ! .Besides even if their is no flashing red lights you should use extreme caution when passing a school bus that has stopped
