Yes they can go to court and get a warrent, but do you think the judge they go to wont give it to them - or you just want to feel good that some person in a black rope gave them a stamp -
for me the issues is security and the less people that know what is going on is better
we have Senators that can't keep secrets - so you think some judge can keep a secret
and anyway that donthave to go to federal judge they can go to what is know as a "secret" judge which basically works only to give them the go ahead on serious legal issues - like spying on AMERICAN citizens - not overseas
