Albany, NY - Rabbi and Spouse Indicted in Theft Scam

Albany, NY - A Capital Region rabbi and his wife were indicted on charges they bilked more than $128,000 from his late father's estate after hiding the money's existence from other family members.

Moshe Berger, and Debra Berger, both 50, are accused of spending the money on trips to California, Florida and Israel, and on clothing, dinners out and jewelry. The couple had power-of-attorney authority for Irving Berger, who lived with them before he died.
The alleged scam was discovered when an interest statement from the couple's bank account was mailed in error to one of Moshe Berger's siblings, according to Albany County Assistant District Attorney David Ehrlich, who is prosecuting the case. "Irving Berger placed his trust in them, and they abused it," Ehrlich said. "They dishonored his memory by using his trust to steal."

The Bergers, of 171 Hollywood Ave. in Albany, were in court as the sealed indictment was opened and read by Albany County Judge Stephen W. Herrick.
Defense attorney Eugene Grenz offered not-guilty pleas on the couple's behalf and turned over their passports to the court. The Bergers were released without bail under the supervision of the Albany County Probation Department.

Debra Berger, who was charged with second-degree grand larceny, faces 5 to 15 years in state prison if convicted. She works for the Maimonides Hebrew Day School of the Capital District, which serves grades pre-K through 12.
Moshe Berger, a rabbi without a congregation, could be sentenced to 1 to 4 years behind bars if found guilty of first-degree falsifying a business record, a felony, and petit larceny, a misdemeanor.

He is employed as a kosher food inspector for Vaad HaKashruth of the Capital Region. The nonprofit council monitors any store, restaurant, factory or other institution that prepares food purported to be kosher.

    If convicted, Maimonides should fire her immediately upon conviction. No ifs ands or buts about it.

    Chilul Hashem must be reigned in.

    Maimonides was a great codifier of Jewish law, as well as Jewish philosophy.

    In Yeshivot he is known as RaMBaM. In Yeshivas he is known as The RaMBaM.

    Maimonides is the name of the local orthodox school in Albany. There are Jews in Albany; there are two frum shuls there.

    Whomsoever judges others to the benefit of the doubt - he is judge to the merit!

    Here is such an opportunity!

    Is it possible that Mr. Berger senior told his son Moshe (and wife) that these funds in particular are theirs and theirs alone in consideration for his living with them for however long a period of time? Is that unreasonable? Mr. Berger has no need to inform his other children of this decision nor does MOshe Bereger or his wife have such an obligation.

    Of course alot greif could have been prevented had Mr. Berger senior made a gift of these funds during his life to Moshe, but there could have been **other** reasons that we don't know about, not the least of which **JEALOUSY** between siblings!

    Let's do the Halachikaly right thing and not condem based on a very few **facts?** that we believe to know.

    May the almighty judge us to the benefit!

    I agree that we shouldn't jump the gun and codemn people based on heresay...but isn't the law the law? It isn't jumping the gun if a judge has found enough evidence to indict, is it? This isn't a rumour that was posted on a gossip board or whispered over coffee and cake...this is a reporting of formal findings and legal judgements.
    Surely, if these two are indeed guilty of such things...betrayal of trust, theft, etc. then are they not rightfully subject to scorn and ridicule? Exclusion?

    an indictment is nothing more than saying there is enough evidence to press charges. The prosecution only speaks at it; therefore, the judge was not jumping to conclusions, nor did he make a decision. I think all of you should be ashamed by engaging in Lashon Harah. Chilul Hashem? Look at all of you.
