New York, NY - HSBC Must Defend in Fraud Lawsuit

New York, NY - A federal appeals court ruled that Bank of America Corp. , HSBC Holdings Plc and Sterling Bancorp must defend against a lawsuit related to a lawyer's Ponzi scheme that defrauded Orthodox Jews and others out of millions of dollars.  
A three-judge panel of the U.S. Second Circuit Court of Appeals on reinstated state law claims brought by dozens of investors alleging that the banks were negligent, and aided and abetted a breach of fiduciary duty. 

The case involved David Schick, a Brooklyn, New York, real estate lawyer who in the early 1990s convinced investors that he had devised a "no-risk" scheme to generate high returns by bidding on and subsequently selling pools of mortgages. 
According to the appeals court, investors would advance funds to Schick, who would then claim to deposit them in escrow accounts at Fleet Bank, now part of Bank of America; Republic National Bank, now part of HSBC; and Sterling National Bank.
Instead, the court said Schick raided the accounts, stealing $82 million before his fraud was discovered.

Investors claimed that the banks were liable because they failed to report overdrafts on Schick's accounts to a state bar committee overseeing client funds, even though he repeatedly bounced checks. "The fact that Schick was overdrawing his fiduciary accounts constituted strong evidence that he was, at the very least, mishandling his clients' funds," Chief Judge John Walker wrote for the appeals panel.   
Bank of America spokeswoman Shirley Norton said the No. 2 U.S. bank intends to "vigorously defend itself" in the case. 

Schick, who was well known in New York's Orthodox Jewish community, in 1997 pleaded guilty to criminal charges in connection with his scheme. Now 46, Schick is scheduled to be released from a federal prison in Otisville, New York, in November 2011, a spokesman for the U.S. Bureau of Prisons said.

    I believe the Banks will win the case. Why go after the Banks? People invested, you take your chances. Anyone who actually thought they could get 20%-25% on their money just shows how greedy people can be. And to see that they are suing the Banks just proves the point. Go after Schick, he put away a nice stash for when he gets out of jail.

    Mr Schick is a bumb. Feel bad for his wife and kids not the one who stole millions from yiden. At the same time I agree with Rabbi Eli Tetelbaub anyone who invests because he is "guranteed" a high percentage that nobody else has ever done is a fool. When are these people going to learn about business?

    I am sure Shicks kids will do nice shiduchim because they do have Money!! Years ago people would not touch a family like this nor would Mr. Schick be allowed in shul but in todays sick society nobody gives a hoot. Of course the Agudah honors such bumbs like this. The Agudah has honored at one point three people in consecutive years and ALL of them are in jail!!

    Rabbi Sherer is rolling in his grave.......

    why dont you archive things, so the first page is only 200-300 k, so it is quicker to load on cellphones, most handhelds will not download more than 500k pages- then all the yeshiva boys will be able to read vosizneias also!

    Nebuch for MR. Schick?? How about the many frum families that lost their life savings, lost their homes, and more, because of his intentional thievery.

    I personally know of a person who after losing his money through Shick died of a heart attack!!

    This man is a rotzeiach. Enough with the pity.

    BUT IS SON OF SCHICK CATERERS
    B)IT IS SAD AND HARD ON FAMILY

    ANon of 2:11 - It was in fact David Schick's father who was the BP Riot guy. Who is one and the same as Schick Caterers!!

    I don't know anything about the guy with the heart attack. But as far as him missing his children's & family simchas, he should of thought of that before he started robbing people blind!
