Kiryas Joel Taxes Stable; No Hike For 8th Straight Year

Kiryas Yoel, the region's municipality, with all the expensive capital projects, has just adopted a $7.4 million budget for the upcoming fiscal year with the same tax rate that was set back in 1997.   Eight years in a row with no tax increase, largely because of the relentless housing construction. That means the tax rate will remain at an unusually low $14.14 per $1,000 of assessed value.
But what about all the big capital projects completed or started since the last tax hike - the sewage treatment plant, the fire station, the chicken slaughterhouse, the convalescence center for mothers? Or the trucks and equipment for the sanitation and fire departments formed since taxes last rose?   Or, for that matter, the money spent so far on engineers and lawyers to plan and defend the village's proposed $21 million water hookup to the Catskill Aqueduct?   The simplest explanation appears to be government grants, which have helped pay for several of the capital projects, and municipal bonds.
Kiryas Joel Administrator explained this week that his village, like other municipalities, accounts for its capital spending outside its operating budget, so that a $21 million water project wouldn't suddenly crank up spending and taxes.

According to a Quinnipiac University poll, the people who voted for Mayor Michael Bloomberg are more than pleased with his performance, the latest poll shows New Yorkers giving the mayor his highest approval rating ever.

A full 75 percent of registered voters polled say they approve of the mayor. Looking ahead, 30 percent of voters said education should be Bloomberg's top priority this term, with 17 percent saying housing should be the main thing for him to focus on. Another 5 percent, however, said terrorism and taxes should be priority number one.

Marin County, CA, - A former finance director for a Kol Shofar synagogue was arrested yesterday on suspicion of embezzling more than $180,000 from the congregation, police said.
The director, who worked for the synagogue from 1999 through last May, was booked into Jail after investigators served a search warrant at his apartment.
Authorities launched an investigation in August, when synagogue employees discovered what they suspected was the unauthorized use of congregation funds. Police said the director, 63, is suspected of using Kol Shofar's credit cards and bank information to obtain the money for himself.
He was booked into the county jail on suspicion of embezzlement, drug possession and bringing drugs or alcohol into a jail or prison.

The investigation into the deaths of five dance-camp students and a counselor who crashed her car in July has led to felony charges against the camp's owner for falsifying state paperwork, officials say.
Sullivan County District Attorney said they learned that camp owner Anna Kapitannikov, whose son was one of the dead, canceled her required worker's compensation insurance three years ago. The state Insurance Fraud Bureau says she faked state paperwork, claiming to still have a comp policy.   The Sullivan County Sheriff's Department has issued a warrant charging her with falsifying business records and failure to maintain worker's compensation coverage.
According to immigration records, Kapitannikov left the country in mid-October.

The Metro North Committee of the MTA approved charging parking fees at lots it owns or controls in Rockland and Orange countie.
Metro North said the fees are necessary to offset the $21million the agency has spent during the past five years to build or improve parking facilities in the two counties.

Commuters who park at the Pearl River station's two lots will be hit the hardest, because they currently don't pay a penny to park.
Those who park at Spring Valley's lot have paid $90 for an annual permit for several years. Metro North took over the lot in 1999.

Austrian Parliament Approves Reparations For Holocaust Survivors

Austrian parliament agreed Wednesday to start paying out hundreds of millions of dollars (euros) in compensation to Holocaust survivors once the last related case against Austria in a U.S. court is settled or dropped. Parliament created the General Settlement Fund in 2001 to compensate Holocaust victims who were robbed of businesses, property, bank accounts and insurance policies during the Nazi era.

The government and Austrian companies earlier this year pledged to pay US $210 million (nearly Ђ167 million) to endow the fund once all court cases against Austria relating to the Holocaust were resolved. But on Wednesday, parliament agreed to speed up the procedure and start payments even before all applications were fully processed, once the last U.S. court case was resolved.

N.Y. Police Commissioner Has a Tough Act to Follow, and It's His Own

NYC Police Commissioner Raymond W. Kelly built the Police Department's counterterrorism program from scratch. He drove crime down further, against predictions and beyond national averages. He has improved relations with the city's black and Latino populations. And, a decade after his first, abbreviated term as New York City police commissioner, he did it all with a shrinking number of officers.

Now, as Mr. Kelly makes good on his pledge to stay on for Mayor Michael R. Bloomberg's second term as the man widely seen as the second most powerful person in city government, people close to him say he will not be satisfied at having gone from underestimated to vindicated. He is, they say, intent on cementing his successes - in fighting terror and in working to bring the department's technology into the 21st century, among others.

Some, including admirers, question his decision to stay, noting that his carefully restored reputation, which came under harsh criticism during the administration of Mayor Rudolph W. Giuliani, could suffer if crime goes up or terrorists attack. Others suggest he might have his eyes on a bigger prize - City Hall. Mr. Kelly, for his part, insists he has no political ambitions, and no great fear of setbacks to his reputation.

Bristol, CT - Jewish Cemetery Defaced

Bristol - Police are looking for anyone with information as to who vandalized the Jewish cemetery on Lake Avenue and drew swastikas on the entry gate and a headstone.

The rabbi of the Congregation of Cheshire, which owns the cemetery, reported it to the police, he said a congregant, whose husband is buried in that cemetery, came to him in tears and reported seeing swastikas on the nameplate at the entry gate to the cemetery. He said the woman’s husband was a survivor of the Holocaust, imprisoned at Auschwitz, and died only a year and a half ago. He said the woman told him her husband spent his life trying to put the memories of the concentration camp behind him, but even after death it seemed the Nazis were chasing him

Police are looking for anyone with information as to who defiled the cemetery, but there was little evidence pointing to a suspect or even a timeline as to when the graffiti was drawn. Police will be increasing patrols in the area of the Lake Avenue cemetery.

A Brooklyn judge has denied a request by Rabbi Aron Teitelbaum's children to appoint guardians over their 91-year-old grandfather leader of Satmar movement Grand Rebbe Moses Teitelbaum, so they could have greater access to him. In the decision, state Supreme Court Justice John Leventhal said the faction that brought the case failed to prove that the grand rabbi was suffering any harm under his current caretakers.
The decision is a blow for Rabbi Aron Teitelbaum, eldest son of the grand rebbe. Several of Aron's children were among those who brought the guardianship petition, which claimed Zalman's allies were holding the aging Satmar leader in virtual isolation in his Williamsburg home. Leventhal said he and his staff visited the grand rebbe at his home on Oct. 31, observed him studying and walking and found him "satisfied with the care he is receiving." Six people look after the Grand Rabbi, including a paramedic and a 24-hour butler, the judge said. "A guardianship proceeding," Leventhal concluded, "is not the proper avenue for a resolution of a family dispute," "We believe the decision was in error," Steven Finkelstein, the petitioners' attorney, responded yesterday. He and his clients hadn't decided whether to appeal.

Senate Approves Bill Requiring Religious Organizations To Disclose Finances

BOSTON - Religious organizations would be required to disclose their finances like other nonprofit groups under a bill overwhelmingly approved by the state Senate.
Supporters of the bill, which has met with opposition from the religious denominations, say there's no reason to exempt religious groups.

The House has yet to take up the bill, but plans to do so, according to a spokeswoman for the House speaker.

Other religious leaders said the bill could put financial strains small, struggling congregations by requiring every congregation, Christian, Jewish, Muslim and others, to pay for financial audits and fees to report their finances to the Attorney General.

Name game in Kiryas Joel's election.   

They might not wield as many votes, but one advantage Kiryas Joel's opposition movement has always had over the village's majority faction is a solid name.   The Kiryas Joel Alliance. The name says it all: we are serious, organized, ready to romp on Election Day. Where did this leave the establishment? Sure, it had a big voting edge and held every elected and appointed office in the village. But where are you without a catchy name?   For village elections, Mayor Abraham Wieder and his allies called themselves the "Experience & Results" ticket. Couldn't get any clunkier than that.   Now, at last, Team Wieder has a political name worthy of its stature. Last week's election instructions came emblazoned with the moniker "Kiryas Joel Anash," "Anash" being an acronym for something Yiddish.   "Anash" sounds more like an Irish folk-rock band than a political party. (We're still waiting for a translation.) But at least it matches the steely resolve of "the Alliance."

Mamaroneck - Yeshiva's Case Hits Federal Court

A religious school's lawsuit against the village of Mamaroneck will go to trial in federal court this week and its outcome may have a significant impact on municipal zoning codes across the state.
The dispute started in 2001 when the Westchester Day School, a yeshiva for more than 400 students, sought permission from the village to erect a 44,000-square-foot building on the school's 26-acre property in Orienta Point.
After a series of hearings, approvals, neighborhood objections, denials, higher court appeals and a recent attempt at a settlement this past summer, the school and village lawyers will present the case before Judge William Connor of the Southern District Court in White Plains beginning at 9:30 a.m. tomorrow.
The first of its kind tried in court in this district, the case is one of about 45 currently in litigation nationally and will test the constitutionality of a controversial federal law passed in 2000.
The lawyers for the school will seek protection under the Religious Land Use and Institutionalized Persons Act, which makes it very difficult for a municipality to stop religious groups from constructing, expanding or renovating buildings unless there's a "compelling interest," such as public safety. But Kevin Plunkett, a lawyer for the village, said discrimination isn't the issue in this case.
In addition to citing traffic, safety and noise concerns, he has said the law is too broad and exempts religious groups from zoning codes, even when there is no evidence of religious discrimination.
"We're not denying them their religious exercise. But this isn't religious exercise, this is a secular exercise. This is about classrooms," Plunkett said.
Also at stake locally may be the large sum in legal fees the village will likely have to pay to its own lawyers and the school's lawyers. This is because a provision in RLUIPA that says that if a religious institution wins, all attorney's fees for both sides are paid by the municipality. But the reverse is not true: If the village wins, it still must pay its own fees.
The school may also seek several millions of dollars in damages for the delay in construction, Bernstein said last week.

NYPD To Test Explosive Detectors In Subways

About a dozen high-tech detectors will be positioned at subway entrances where officers conduct random bag searches.
Instead of searching by hand, the officers will swab the outside of bags. The detectors can analyze the swabs for traces of explosives within a few seconds.
One of the devices can detect evidence both of traditional explosives like TNT and of homemade fertilizer bombs. The department paid between $25,000 and $50,000 for each detector.
