Airmont Seeks To Void Yeshiva Agreement

AIRMONT -- The village will be in federal court next month to attempt to void a settlement with a developer planning to build a yeshiva with housing for students and faculty.

In a split vote, the village board approved the settlement - which gave the congregation the right to present its proposal to the Planning Board - as the village faced the threat of a discrimination lawsuit by the U.S. Justice Department.

Then, after the settlement, the government sued the village anyway - that lawsuit continues - because there was no zoning to accommodate such projects.

Mayor John Layne, who signed the settlement with the approval of the then-village board majority, said that he relied on the best legal advice available when he agreed to the settlement.

Two months after the settlement, Layne lost his village board majority, and the new board hired the White Plains law firm to replace the one that had negotiated the settlement.

"I feel disrespected - I'm paying taxes but I'm a nobody," said Sampieri, 70, a retired jewelry maker.

The most recent inspection came only after the media called the Buildings Department to ask about the case.

While the case is being investigated, building officials said that so far they have found no evidence that the neighboring structure is too close to Sampieri's home - and that it might turn out that Sampieri's roof encroaches on his neighbor's property.

Tuna The King of the Sea

Moshe Freund gave the name of his tuna fish company "The King of the Sea." He company started out in Brooklyn, New York by working from his home, then from a narrow loft that he built directly above the refrigerator in his father's fish store - a loft so small, he says, "that I couldn't stand straight." a year or so ago, he says, he saw another opportunity, this time to expand beyond his kosher base in New York by He stepped out of his relatively closed community and hired a marketing and communications company in Morristown, N.J., to spread the word.

The name raised the feathers of the company Chicken of the Sea out of California. Chicken of the Sea sent to Mr. Freund a letter, expressing concern about the phrase "of the sea," and the potential confusion between a behemoth in California and a little guy in New York.

A spokeswoman for Chicken of the Sea said in an e-mail message yesterday that the company hopes for an "amicable solution." Mr. Freund, who fears costly litigation, fervently shares that hope, though he doesn't quite see the issue.

"There's so many things coming from the sea," says its king Mr Freund.

Fallsburg's Growth Pits Old vs. New

Loch Sheldrake - FallsburgWatch wants a building moratorium to ban the 10 bungalows per acre allowed in this town of 12,000 that explodes to 60,000 in the summer. They see the thousands of new homes planned for this town and say "not so fast." while Fallsburg writes a new plan for the growth.

But developers and workers who build those homes – along with some longtime residents – say a moratorium is wrong, especially in a town where some 40 percent of the property is off the tax rolls. And besides, said a builder, who's built 1,200 homes for Orthodox Jews and Hasidim, his developments aren't bungalows. They're year-round homes with cathedral ceilings and oak floors that are mostly used two months per year. The owners pay taxes – although some pay less because the homes are condos.
